The following sets for the Privacy Policy (“Privacy Policy”) of JustFund.Us (“JustFund”, “we” or “our”), and is incorporated into and made a part of JustFund’s Terms of Use, available at https://www.justfund.us/terms-of-use.

The privacy of your personal information (in some countries referred to as “personal data” or “personally identifiable information”) is important to us. We provide you with this Privacy Policy so that you will understand our commitment to you and to your data privacy. This Privacy Policy describes what information we may collect about you; how we store and process your information; how we protect it; and how to assert your rights and preferences regarding how your information is collected and processed.

As our Privacy Policy changes in significant ways, we will make reasonable efforts to notify you of the changes. Minor changes to the Privacy Policy may occur without notification as long as they do not affect our collection or processing of personally identifiable data. As new features and functionalities are added, we may need to update or review the Privacy Policy and reserve the right to do so at any time, without prior notice and by posting the revised version. In case we modify this Privacy Policy in a way that your awareness of the changes shall be required, we may provide notice at the top of the Privacy Policy for at least 30 days after the new effective date so that you can see at a glance that the Privacy Policy has changed.

Introduction

This Privacy Policy describes the types of information we may collect from you or that you may provide when you visit the website www.justfund.us and any applicable subdomains thereof, and through any applications, mobile applications, functionalities, content, materials, or other online services provided by JustFund (the “Platform”) and our practices for collecting, using, maintaining, protecting and disclosing that information.

This Privacy Policy does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by JustFund or any third party (including our affiliates and subsidiaries); or

  • Any third party (including our affiliates and subsidiaries), including through any application or content that may link to or be accessible from or on the Platform. Such collection will be governed by the privacy policy of the respective third party, which we encourage you to review for more information about their data collection practices.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will process it. If you do not agree with our policies and practices, your choice is not to use our Platform. By accessing or using this Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of this Platform after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Persons Under the Age of 18

Our Platform is not intended for use by persons under 18 years of age. No one under age 18 may provide any personal information to or on the Platform. We do not knowingly collect personal information from persons under 18. If you are under 18, do not use or provide any information on this Platform or on or through any of its features, register on the Platform, make any purchases through the Platform, use any of the interactive or public comment features of this Platform. If we learn we have collected or received personal information from a person under 18 without verification of parental consent, we will remove that information. Children Under 13 (COPPA)

The Children’s Online Privacy Protection Act (“COPPA”) imposes specific requirements on operators of online services directed at, or that knowingly collect information from, children under 13. The Platform is not directed at children under 13, and we do not knowingly collect personal information from any child under 13. If you believe we may have collected personal information from a child under 13, please contact us immediately at privacy@justfund.us so we can promptly delete it. Where required, we will obtain verifiable parental consent before collecting personal information from a child under 13.

Notice at Collection

At or before the point of collection, we provide you with this short notice describing what we collect and why. We collect the categories of personal information described in Section 5 (Categories of Personal Information) for the purposes described in Section 6 (How We Use Your Information). We retain personal information for the periods described in Section 11 (Data Retention). We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Platform, including information:

  • By which you or your organization may be personally identified, such as name, postal address, email address, telephone number, IP Address, Geographic information, and Pictures, (“personal information”);

  • For financial transactions, such as payment account details for fulfillment of member registration, payment information for donations, and billing information.

    • We use third party payment processors to process financial information. For example, we use Stripe and others for payments, analytics and other business services. These payment processors may collect personal data, including via cookies and similar technologies. The personal data they collect includes transactional data and identifying information about you and the devices that connect to their services. They use this information to operate and improve the services provided to us, including fraud detection, loss prevention, authentication, and analytics related to the performance of services. They operate both as processors for us and independent controllers for the information they collect directly from you.

  • That is about you but individually does not identify you; and/or

  • About your internet connection, the equipment you use to access our Platform, and usage details.

We collect this information:

  • Directly from you when you provide it to us.

  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses and information collected through cookies, web beacons and other tracking technologies.

  • From third parties, for example, our business partners.

Categories of Personal Information We Collect

The table found here describes the categories of personal information we collect, the sources we collect them from, the purposes for which we use them, the categories of recipients we share them with, and how long we retain them. The category labels follow the framework used by the California Privacy Rights Act (CPRA) so that this section also satisfies CCPA/CPRA disclosure requirements where applicable. Specific named recipients (sub-processors) are listed at www.justfund.us/sub-processors.

Sensitive Personal Information

Some of the personal information we collect is “sensitive personal information” under CPRA and similar state laws (for example, account credentials and the contents of communications you send through the Service). We use sensitive personal information only to provide the Service and do not use it to infer characteristics about you.

Sources of Personal Information

We collect personal information from the following sources: (i) directly from you, when you create an account, complete a form, make a donation, upload content, or contact us; (ii) automatically, through cookies, SDKs, and similar tracking technologies described in Section 10; (iii) from foundations, donor networks, or other organizations that refer you to or through the Platform; (iv) from our service providers, including payment processors and analytics providers, in the ordinary course of providing the Service; and (v) from publicly available sources where appropriate (for example, public IRS records used to verify tax-exempt status of grantees).

Information You Provide to Us

The information we collect on or through our Platform may include:

  • Information that you provide by filling in forms or uploading information or documentation through our Platform.

  • Records and copies of your correspondence (including email addresses), if you contact us.

  • Your responses to surveys that we might ask you to complete for research purposes.

  • Details of transactions you carry out through our Platform and of the fulfillment of your membership registration. You may be required to provide financial information before registering as a member with our Platform.

  • Information that you provide when making a donation to JustFund.

  • Your search queries on the Platform.

You also may provide information to be published or displayed (hereinafter, “posted”) on publicly viewable areas of the Platform, also known as “Community Activity”, or transmitted to other users of the Platform or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Platform with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:

  • Details of your visits to our Platform, including traffic data, location data, logs and other communication data and the resources that you access and use on the Platform.

  • Information about your computer and internet connection, including your IP address, operating system and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). The information we collect automatically is statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Platform and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our Platform according to your individual interests.

  • Speed up your searches.

  • Recognize you when you return to our Platform.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Platform.

  • Web Beacons. Pages of our Platform and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit JustFund, for example, to count users who have visited those pages or opened an e-mail and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

Third-party Use of Cookies and Other Tracking Technologies

Some content or applications on the Platform may be served by third-parties. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Platform and its contents to you.

  • To process and receive donations that you make to JustFund.

  • To provide you with information, products or services that you request from us.

  • To fulfill any other purpose for which you provide it.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.

  • To notify you about changes to our Platform or any products or services we offer or provide though it.

  • To allow you to participate in interactive features on our Platform.

  • In any other way we may describe when you provide the information.

  • For any other purpose with your consent.

We may also use your information to contact you about our own and third-parties’ services that may be of interest to you. If you do not want us to use your information in this way, please check the relevant box located on the form on which we collect your data.

Disclosure of Your Information

We may disclose deidentified or aggregated information that does not identify any individual, provided that we maintain reasonable technical and contractual safeguards to prevent reidentification. We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.

  • To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To a successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of JustFund’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by JustFund about our Platform users is among the assets transferred.

  • To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To fulfill the purpose for which you provide it.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent. For example, if in connection with making a donation, you opt in to sharing your name and/or contact information with the participating charity(ies), we will disclose such information to the participating charity(ies).

We may also disclose your personal information:

  • To comply with any court order, law or legal process, including to respond to any government or regulatory request.

  • To enforce or apply our Platform Terms of Use and other agreements, including for member billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of JustFund, our members or others.

How We Use AI

JustFund uses or may use artificial intelligence (“AI”) and machine-learning technologies to support certain features of the Platform. This section describes how we use AI and the choices you have. The specifics in this section are subject to change as our AI use evolves; current detail (including the AI service providers we use) is maintained at www.justfund.us/sub-processors.

How AI Uses Your Data

When you use an AI feature, the inputs you provide (and, where applicable, related Platform data) are processed by the AI service provider on our behalf to generate a response. AI service providers process this data as our service providers (processors) and are contractually restricted to processing the data only as instructed by us. AI service providers do not use your inputs or outputs to train third-party foundation models; certain providers may use your inputs to improve their AI services to JustFund where contractually permitted, with sensitive-data exclusions enabled where available. AI prompts and outputs are retained as part of our overall retention schedule (see Section 11).

AI Limitations and Your Choices

AI-generated content may be incomplete, inaccurate, or out of date. You are responsible for reviewing and verifying AI outputs before relying on them, particularly for decisions affecting funding, grant-making, taxes, or compliance. AI features are provided to support your work, not to substitute for professional judgment. We do not currently use AI to make decisions about you that produce legal effects or significantly similar effects without human review; if that changes, we will update this Privacy Policy. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

You may communicate with us via email at privacy@justfund.us to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Platform, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Platform users. Proper access and use of information provided on the Platform, including User Contributions, is governed by our Terms of Use.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment in connection with a membership registration will be encrypted.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Platform like message boards. The information you share in public areas may be viewed by any user of the Platform.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

Service Providers and Sub-Processors

We rely on a number of trusted third-party service providers to operate the Platform. These include providers of: payment processing; hosting and infrastructure; analytics and product-improvement telemetry; community and collaboration features; customer support; communications; and AI processing. We require each service provider to handle your information in accordance with this Privacy Policy and applicable law, and we have a written agreement with each that restricts their use of your information to providing services to us. A current list of our service providers and sub-processors, including the categories of data each receives, is available at www.justfund.us/sub-processors. Where required by applicable law, we will provide notice of material changes to our sub-processor list.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, and to enforce our agreements. In general: account information is retained for the duration of your account; transaction and donation records are retained for at least seven (7) years to comply with tax and accounting requirements; communications and analytics data are retained for the period reasonably necessary to support the Service and are then deleted or de-identified; and content you delete from the Platform is removed from active systems within a reasonable period but may persist in backups before being overwritten. We may retain information longer where required or permitted by law, including to comply with legal holds, investigations, or regulatory obligations.

Data Breach Notification

We maintain administrative, technical, and physical safeguards designed to detect and respond to security incidents. In the event of a breach of security that compromises your personal information, we will notify you and applicable regulators in accordance with applicable law. Where feasible, notification will occur in the most expedient time possible and without unreasonable delay, and in any event within seventy-two (72) hours of our determination that a notifiable incident has occurred, except as delayed by law-enforcement request or as otherwise permitted by law.

Your U.S. State Privacy Rights

Depending on where you live, you may have additional rights regarding your personal information under state privacy laws, including the laws of California, Virginia, Colorado, Connecticut, Utah, Texas, and other states. The rights described below apply where you are a resident of one of those states and where the applicable law applies to JustFund’s processing of your personal information.

Your Rights

Subject to applicable law and verification of your identity, you may have the right to: (i) know what personal information we have collected about you, the sources from which we collected it, the purposes for which we use it, and the categories of recipients with whom we share it; (ii) access a copy of the personal information we maintain about you in a portable format; (iii) correct inaccurate personal information; (iv) delete personal information we have collected from you, subject to specified exceptions; (v) opt out of the sale or sharing of personal information (we do not sell or share personal information for cross-context behavioral advertising, but you have the right to direct us not to do so in the future); (vi) limit our use of sensitive personal information to specified purposes; (vii) opt out of profiling that produces legal or significantly similar effects; and (viii) appeal a denial of any of these rights.

How to Exercise Your Rights

To exercise any of these rights, contact us at privacy@justfund.us. We will verify your identity using information already associated with your account before responding. We will respond within the timeframes required by applicable law (generally 45 days, with one 45-day extension where reasonably necessary). You may designate an authorized agent to make a request on your behalf; we will require written authorization signed by you and may also require verification of the agent’s identity.

“Do Not Sell or Share My Personal Information”

We do not sell your personal information for monetary consideration, and we do not share your personal information with third parties for cross-context behavioral advertising. If our practices change, we will update this Privacy Policy and provide an opt-out link as required by applicable law.

Non-Discrimination

We will not discriminate against you for exercising any of these rights. We will not deny you the Service, charge you different prices or rates, or provide a different level of quality of the Service because you exercised your rights, except where the difference is reasonably related to the value provided to us by your data and is permitted by applicable law.

Authorized Agent

You may designate an authorized agent to submit requests on your behalf. To do so, the agent must provide us with written authorization signed by you, and we may require you to verify your own identity directly with us. We will deny requests from agents who do not provide proof that they have been authorized by you to act on your behalf.

International Visitors

The Platform is intended for users in the United States. If you access the Platform from outside the United States, your information will be transferred to, processed, and stored in the United States, where data-protection laws may differ from those in your jurisdiction. By using the Platform, you understand that your information may be processed in this manner. If you are a resident of the European Economic Area, the United Kingdom, or another jurisdiction that grants you data-protection rights, you may have rights with respect to your personal information under applicable law (including rights of access, correction, deletion, portability, restriction, objection, and the right to lodge a complaint with a supervisory authority). To exercise any such rights, contact privacy@justfund.us. We will respond consistent with applicable law and our resources.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Platform home page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account and/or through a notice on the Platform home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Platform and this privacy policy to check for any changes.
