Acceptable Use Policy

This Acceptable Use Policy supplements our Terms of Use and sets out acceptable and unacceptable uses for our Service. You understand that this is not a comprehensive list and JustFund.us (“JustFund”, “we”, “our” or “us”) reserves the right to update this Acceptable Use Policy from time to time at our discretion. You are encouraged to check this page regularly to review our current Acceptable Use Policy. If we believe there has been or may be a breach of this Acceptable Use Policy by you (or your authorized users), or activities that present a credible risk of harm to other users, our customers, the Service or any third parties, we may suspend or terminate your access to the Service and the Portal. Capitalized terms used below but not defined in this policy have the meaning set forth in the Terms of Use.

You will do the following:

  • comply with the Terms of Use, including the terms of this Acceptable Use Policy;
  • comply with all applicable laws and governmental regulations, including, but not limited to, all intellectual property, data, privacy, and export control laws, and regulations promulgated by any government agencies, including, but not limited to, the U.S. Securities and Exchange Commission, and any rules of any national and other securities exchanges;
  • upload and disseminate only information, data and User Contributions to the Portal which you own all required rights under law and under contractual and fiduciary relationships (such as proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements) and do so only consistent with applicable law;
  • use commercially reasonable efforts to prevent unauthorized access to or use of the Service and the Portal;
  • keep passwords and all other login information confidential;
  • monitor and control all activity conducted through your account in connection with the Service and the Portal;
  • promptly notify us if you become aware of or reasonably suspect any illegal or unauthorized activity or a security breach involving your accounts or teams, including any loss, theft, or unauthorized disclosure or use of a username, password, or account; and
  • comply in all respects with all applicable terms of the third party applications, including any that you elect to integrate with the Portal that you access or subscribe to in connection with the Service.

You will not do the following:

  • permit any third party that is not an authorized user to access or use a username or password for the Portal or the Service;
  • permit direct or indirect access to or use of the Portal in a way that circumvents a contractual usage limit or blocked or restricted services; 
  • share, transfer or otherwise provide access to an account designated for you to another person;
  • use the Portal to store or transmit any information or data that may infringe upon or misappropriate someone else’s trademark, copyright, or other intellectual property, or that may be tortious or unlawful;
  • upload to, or transmit from, the Portal or the Service any data, file, software, or link that contains or redirects to a virus, Trojan horse, worm, or other harmful component or a technology that unlawfully accesses or downloads content or information stored within the Portal or available through the Service or on the hardware of JustFund or any third party;
  • attempt to reverse engineer, decompile, hack, disable, interfere with, disassemble, modify, copy, translate, or disrupt the features, functionality, integrity, or performance of the Service or the Portal (including any mechanism used to restrict or control the functionality of the Portal), any third party use of the Service or the Portal, or any third party data contained therein (except to the extent such restrictions are prohibited by applicable law) , or otherwise attempt to derive any source code or underlying ideas or algorithms of the software of any other part of the Portal (except to the extent such restriction is expressly prohibited by applicable statutory law);
  • attack the Portal via a denial-of-service attack or a distributed denial-of-service attack
  • attempt to gain unauthorized access to the Service, the Portal, or related systems or networks or to defeat, avoid, bypass, remove, deactivate, or otherwise circumvent any software protection or monitoring mechanisms of the Service or the Portal;
  • use the Portal in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Portal, including their ability to engage in real time activities through the Portal, or otherwise interfere with the proper working of the Portal;
  • use any robot, spider or other automatic device, process or means to access the Portal for any purpose, including monitoring or copying any of the material on the Portal;
  • use any manual process to monitor or copy any of the material on the Portal or for any other unauthorized purpose without our prior written consent;
  • access the Service or the Portal in order to build a similar or competitive product or service or copy any ideas, features, functions, or graphics of the Service or the Portal;
  • use the Service or the Portal in any manner that may harm minors or that interacts with, requests personal information from, or targets people under the age of sixteen;
  • without the express prior written consent of JustFund, conduct any benchmarking or comparative study or analysis involving the Portal for any reason or purpose except, to the limited extent absolutely necessary, to determine the suitability of the Portal to interoperate with your internal system;
  • remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in the Portal;
  • engage in activity that incites or encourages violence or hatred against individuals or groups;
  • impersonate any person or entity, including, but not limited to, an employee of JustFund, a Member, an administrator, or any other authorized user (including without limitation, using email addresses or screen names associated with any of the foregoing), or falsely state or otherwise misrepresent your affiliation with a person, organization or entity;
  • access, search, or create accounts for the Service or the Portal by any means other than our publicly supported interfaces (for example, "scraping" or creating accounts in bulk);
  • send advertising or promotional material, unsolicited communications, promotions or advertisements, or spam;
  • send altered, deceptive or false source-identifying information, including "spoofing" or "phishing";
  • sublicense, resell, timeshare, rent, lease or similarly exploit the Service or the Portal, or include the Portal in a service bureau or outsourcing offering;
  • modify, display, republish or create derivative works based on the Portal or the Service;
  • use contact or other user information obtained from the Service or the Portal (including email addresses) to contact Members or authorized users outside of the Service and Portal without their express permission or authority or to create or distribute mailing lists or other collections of contact or user profile information for authorized users for use outside of the Services; 
  • authorize, permit, enable, induce or encourage any third party to do any of the above.
  • use the Portal or the Service to contact or communicate with people outside your organization or recommend grants, unless you have a professional relationship or common business activity, for example, as a donor advisor;
  • to engage in any other conduct that restricts or inhibits anyone’s use of or enjoyment of the Portal or the Service, or which, as determined by us, may harm JustFund, Members or users of the Portal and expose us or them to liability; 
  • use the Service or the Portal to export grant recommendations, Member information, organization lists, or any reports or documents containing data or recommendations from the Portal or the Service (collectively referred to as “Portal Data”), except for the sole and limited purpose of sharing Portal Data in unmodified form with prospective donors and to your governing board, advisory council, or decision-making body for the sole purpose of evaluating or recommending grants. Without limiting the foregoing, you may not, under any circumstances, use Portal Data to augment or enrich your own databases or products and services.
